Elon Musk’s lawyer has confirmed that the lawsuit against OpenAI and its restructuring plans will move forward, despite recent attempts by the AI company to dismiss claims. Musk’s attorney, Alex Spiro, stated that the legal team remains committed to “holding OpenAI accountable” for what they describe as a breach of founding commitments. The lawsuit accuses OpenAI’s leadership — including CEO Sam Altman and President Greg Brockman — of transforming the organisation into a closed commercial entity primarily benefiting Microsoft, its largest investor.

According to the filing, OpenAI’s transition to a capped-profit model and integration with Microsoft’s Azure and Copilot platforms constitute a departure from its mission to develop AI for the benefit of humanity. The complaint seeks greater transparency, governance reform, and potential structural separation from Microsoft.

OpenAI has maintained that its structure remains consistent with its mission and has called Musk’s allegations “unfounded.” Legal experts note that the case could set an important precedent for AI ethics, corporate governance, and public accountability in the tech sector.
