On Tuesday, the United Kingdom’s Competition and Markets Authority (CMA) announced the initiation of a formal investigation into Microsoft’s (MSFT.O) recent hiring practices and its partnership with Inflection AI. This move comes as part of a broader global trend where regulatory bodies are increasingly scrutinizing potentially anti-competitive behaviors within the rapidly growing artificial intelligence (AI) sector.

 Focus of the Investigation

The investigation specifically targets Microsoft’s recent actions, including its recruitment of former Inflection AI employees and its strategic collaboration with the startup. Over the past 18 months, there has been a notable intensification of regulatory oversight concerning Microsoft’s various agreements with smaller tech firms, particularly those in the AI industry.

In March, Microsoft made headlines by hiring Mustafa Suleyman, a prominent figure in the AI field and co-founder of Google DeepMind (GOOGL.O), to lead its newly established AI unit. This move was followed by the recruitment of several employees from Inflection AI, a company Suleyman founded in 2022.

 Financial Details and Impact

Reports indicate that Microsoft had agreed to pay Inflection AI approximately $650 million as part of their partnership deal. This substantial financial commitment not only granted Microsoft access to Inflection’s advanced AI models but also enabled the startup to settle financial obligations with its investors, which include high-profile figures such as former Google CEO Eric Schmidt and billionaire Bill Gates.

 Microsoft’s Response

In response to the CMA’s investigation, a Microsoft spokesperson expressed confidence in the legality and competitive nature of their hiring practices. In an emailed statement to Reuters, the spokesperson stated, “We are confident that the hiring of talent promotes competition and should not be treated as a merger. We will provide the UK Competition and Markets Authority with the information it needs to complete its enquiries expeditiously.”

Investigation Timeline and Context

The CMA has set a deadline of September 11 to determine whether the deal warrants a more comprehensive investigation. This scrutiny comes amidst growing concerns over Microsoft’s influence and control in the AI sector, compounded by its relationships with leading AI startups such as OpenAI and France’s Mistral AI.

Just last week, Microsoft relinquished its board observer seat at OpenAI in a bid to address antitrust regulators’ concerns regarding its level of control over the AI startup. The CMA is also seeking public input on other notable partnerships in the AI industry, including those between Amazon (AMZN.O) and Anthropic.

 Broader Implications

This investigation highlights the increasing vigilance of global regulators as they navigate the complexities of the AI industry. With Microsoft’s significant investments and strategic moves in the AI space, the regulatory scrutiny underscores the critical balance between fostering innovation and ensuring fair competition in the tech sector.

In summary, the CMA’s investigation into Microsoft’s hiring practices and its partnership with Inflection AI reflects a growing regulatory focus on the competitive dynamics within the AI industry. As the investigation progresses, it will be crucial to monitor how these developments may impact Microsoft’s strategic objectives and the broader AI landscape.
